Federal tax treatment
By default, a single-member LLC is often disregarded for federal tax purposes and a multi-member LLC is often taxed as a partnership. An LLC can elect corporate tax treatment if eligible.
That classification affects federal returns, Montana returns, owner reporting, payroll, and estimated tax planning.
Montana tax accounts
Montana DOR says businesses pay income taxes based on how they are registered with IRS. In addition to income tax, businesses may owe withholding taxes, natural resource taxes, or other miscellaneous taxes.
DOR says you must register for a Montana withholding tax account if you issue Montana wages, issue Forms W-2, or issue Forms 1099 with withholding. Registration can be handled through TAP or by mail using the business registration form.
Unemployment insurance
