Who can serve?
A Texas registered agent can generally be:
- An individual Texas resident
- A domestic entity
- A foreign entity registered to do business in Texas
The registered office must be a physical street address in Texas where process can be served. It cannot be only a mailbox service.
Consent matters
Texas Form 205 says a person designated as registered agent has consented to serve in that capacity. Texas Secretary of State guidance also explains that consent is not generally filed with the Secretary of State, but the entity should keep it in records.
Do not list a commercial registered agent until the provider accepts the appointment and gives exact details.
