Educational guide, not legal or tax advice.
North Carolina LLC taxes are separate from the $125 formation filing and the $200/$203 annual report. The actual obligations depend on federal tax classification, the business activity, sales, employees, and local jurisdiction.
Educational note: This guide is for general informational purposes only. It is not legal, tax, accounting, or financial advice. Confirm current requirements with IRS, North Carolina Department of Revenue, Department of Commerce, local agencies, and qualified professionals.

Federal tax treatment
By default, a single-member LLC is often disregarded for federal income tax purposes and a multi-member LLC is often taxed as a partnership. An eligible LLC can elect corporate tax treatment.
That classification affects federal returns, owner reporting, payroll, estimated taxes, and the North Carolina filings that may follow.
North Carolina registration and taxes
The North Carolina Department of Revenue separately handles sales and use tax, withholding, and other tax registrations. NC-BR is not the same as forming the LLC and is not a substitute for a federal EIN.
Review tax registration before taxable sales or covered payroll activity. Local governments can add separate business taxes or filings.
Employer filings
When hiring, review North Carolina withholding, unemployment insurance, new-hire reporting, wage reporting, and workers’ compensation requirements. These are separate from the EIN and annual report.
Do not mix up filings
Keep these separate:
- Articles of Organization: creates the North Carolina LLC
- Annual report: $200 paper or $203 online, due April 15
- EIN: federal IRS identification number
- NC-BR: applicable North Carolina tax registration
- Tax returns: recurring federal and state reporting
- Licenses and permits: local, professional, and industry rules
Tax FAQ
Does every North Carolina LLC pay the same tax?
No. Tax depends on classification, activity, income, sales, employees, and local facts.
Does formation register sales tax?
No. NC-BR and other tax accounts are separate.
Does the annual report pay taxes?
No. It is a Secretary of State business-information filing, not a tax return.
Is EIN free?
Yes. EINs are free when requested directly from the IRS.
