Federal and Maryland income tax

By default, a single-member LLC is often disregarded for federal tax purposes and a multi-member LLC is often treated as a partnership. An LLC can elect corporate tax treatment if eligible.

Maryland tax filing depends on that classification and the owners’ facts. Do not assume the LLC’s SDAT filing alone tells you which income tax forms apply.

Comptroller Combined Registration

The Comptroller’s Combined Registration Application can be used to register for Maryland tax accounts including:

  • Admissions and amusement tax account
  • Tire recycling fee
  • Transient vendor license
  • Unemployment insurance account

The Comptroller says businesses generally need a federal employer identification number before registering, unless they are a sole proprietorship applying only for a sales and use tax license and do not have a FEIN.

Annual report and personal property

Maryland’s annual compliance can involve both Annual Report and Personal Property Return concepts. The annual report fee for an LLC is generally $300, and the standard due date is April 15.

This is separate from sales tax returns, income tax returns, and employer withholding reports.

Does forming a Maryland LLC register sales tax?

No. Use the Comptroller registration process if the LLC needs a sales and use tax license.

Does every Maryland LLC file a corporation income tax return?

Not necessarily. The Comptroller notes that S corporations, partnerships, and LLCs generally should not file a corporation income tax return; these businesses must file as pass-through entities. Confirm based on your tax classification.

Is the $300 annual report a tax return?

No. It is an SDAT annual report filing fee, although Maryland’s annual filing process also relates to business personal property reporting.

Does Maryland have local license taxes?
