Federal tax treatment

By default, a single-member LLC is often disregarded for federal income tax purposes and a multi-member LLC is often taxed as a partnership. An eligible LLC can elect corporate tax treatment. That choice affects federal returns, owner reporting, payroll, and estimated taxes.

Pennsylvania sales and business taxes

Businesses selling taxable items or performing taxable services generally need a Sales, Use, and Hotel Occupancy Tax License through myPATH. Pennsylvania also has business and entity-level tax programs that may apply based on the LLC’s tax classification and activity.

Do not assume the Certificate of Organization, EIN, or annual report completes tax registration.

Employer filings

Pennsylvania requires employers to review personal income-tax withholding. Employers may also need unemployment compensation registration, new-hire reporting, wage reporting, and workers’ compensation coverage. The EIN is only the federal identifier.
