Federal tax treatment

By default, a single-member LLC is often disregarded for federal tax purposes and a multi-member LLC is often taxed as a partnership. An LLC can elect corporate tax treatment if eligible.

Missouri DOR registration

Missouri DOR says businesses can register online for tax types including sales tax, vendor’s use tax, consumer’s use tax, withholding tax, unemployment tax, tire and lead acid battery fee, and corporate income tax.

DOR also says a business must obtain a sales tax license by registering if it makes sales of tangible personal property or taxable services. A business should also register if it has employees and must remit withholding tax.

Unemployment tax

Missouri unemployment rules are separate from Secretary of State formation and separate from ordinary income tax. The Department of Labor says most employing units become liable by meeting one or more criteria, and a general business employer can become liable based on wage or week thresholds, FUTA liability, or successor status.

If the LLC becomes liable, the employer generally needs to notify the Division within 30 days and can register online.
