New Hampshire LLC taxes are not limited to the federal return. New Hampshire has no broad sales tax, but the Department of Revenue Administration administers Business Profits Tax, Business Enterprise Tax, Meals and Rooms tax, tobacco, communications, and other programs.

Federal tax treatment

By default, a single-member LLC is often disregarded for federal tax purposes and a multi-member LLC is often taxed as a partnership. An LLC can elect corporate tax treatment if eligible.

That classification affects federal returns, New Hampshire returns, owner reporting, payroll, and estimated tax planning.

New Hampshire business taxes

New Hampshire DRA administers Business Profits Tax and Business Enterprise Tax. DRA’s filing thresholds and rates can change, so use the current DRA guidance rather than assuming that a small LLC has no New Hampshire tax filing.

DRA also has a separate Meals and Rooms tax for restaurants, lodging, and motor vehicle rentals. Covered operators need a license before operating and must collect and remit the tax.

Employer filings

New Hampshire DRA says businesses with employees must contact NH Employment Security. NHES handles employer status, new-hire reporting, and wage and tax reports. These are separate from the EIN and Secretary of State annual report.
