Educational guide, not legal or tax advice.

Forming a DC LLC does not automatically license the business to operate. The $99 DLCP entity filing creates the LLC. Licenses and permits depend on the business activity, location, tax accounts, trade name, and whether customers are served in the District.

Basic Business License

DLCP says each licensed business activity has its own requirements and that anyone engaging in business activity in DC must be licensed according to the specific activity conducted.

As of July 28, 2026, DC Code section 47-2851.04 shows temporary BBL fee text with $49 for a 6-month license, $99 for a 2-year license, and $198 for a 4-year license. Because the official law page notes temporary legislation expiring August 13, 2026, recheck the current fee before applying.

Tax registration comes before many licenses

DC’s business licensing law requires proof of entity filing, tax registration, occupancy, and clean hands status for a basic business license. The DC Business Portal lists FR-500 business tax registration at $0.

Do not wait until a license application asks for tax registration to start the process.

Certificate of Occupancy or Home Occupation Permit

If the LLC has a physical business location, a Certificate of Occupancy may apply. If it operates from a residence, a Home Occupation Permit may apply. These are separate from forming the LLC and separate from registered agent service.

Common mistakes

Treating LLC formation as permission to operate

Entity formation is only one piece. DC is license-heavy for many activities.

Missing BBL category requirements

Each activity can have different documents, inspections, or approvals.

Ignoring occupancy rules

Physical and home-based locations can trigger separate requirements.

Using a trade name without registering it

DLCP says trade names are optional, but must be registered if used in DC.

License FAQ

Does every DC LLC need a Basic Business License?

It depends on the business activity, but many businesses operating in DC need one. Check the DC Business Portal and DLCP category.

Is FR-500 a license?

No. It is business tax registration.

Is the registered agent address enough for a BBL?

Not necessarily. BBL, occupancy, and tax location rules can require actual business location information.

Does DC have professional licenses?

Yes. Professional licensing depends on the occupation.
